While Michigan has identity theft statutes, there are no direct equivalents to the aggravated identity theft enhancement under Federal Law.
Aggravated identity theft involves knowingly using another person’s identifying information during and in relation to certain felony offenses. These cases often arise from financial transactions, online activity, employment records, device extractions, and alleged fraud schemes.
Federal prosecutors must prove that the defendant knowingly used another’s identity, that the identity belonged to a real person, and that the use occurred during a qualifying underlying offense. Evidence often includes spreadsheets, digital-forensic reports, financial statements, and IP logs—frequently with uncertain attribution.
